Sustainable Precision System - Terms and Conditions

End user license agreement

This end user license agreement ("agreement") is a legal agreement between you (either an individual or a single entity) and Sustainable Precision Systems regarding The Sustainable Precision Systems software program ("software").

By installing, using, or accessing the software, you agree to be bound by the terms of this agreement. If you do not agree to the terms of this agreement, do not install, use, or access the software.

• License Grant

  Sustainable Precision Systems grants you a non-exclusive, non-transferable, revocable license to use the software for your personal or internal business purposes.

• Ownership

  All data output ("reports") produced by Sustainable Precision Systems is owned by and proprietary to Sustainable Precision Systems. You may not share any such reports without permission, and acknowledging Sustainable Precision Systems as the source.

• User Accounts

  A Sustainable Precision Systems user-account is licensed to a single natural person, and user-account login may not be shared. Sustainable Precision Systems allows for multiple user-accounts to be created per farm-account. I.e. No account-sharing or 3rd party access is permitted.

• League Reports

  Distribution of league data output ("league reports") may not be shared with any entity that does not form part of the league.

• SA POPI Act

  All user (“farmer/farm data”) has to be secured within the boundaries of the South African POPI act. No 3rd party access from an external source is permitted.

• Disclaimer of Warranties

  The software is provided "as is" without warranty of any kind. Sustainable Precision Systems disclaims all warranties, either express or implied, including the warranties of merchantability and fitness for a particular purpose.

• Imitation Of Liability

  In no event shall Sustainable Precision Systems be liable for any damages whatsoever (including, without limitation, damages for loss of business profits, business interruption, loss of business information, or other pecuniary loss) arising out of the use or inability to use the software, even if Sustainable Precision Systems has been advised of the possibility of such damages.

• General

  This agreement shall be governed by and construed in accordance with the laws of South Africa. This agreement constitutes the entire agreement between you and Sustainable Precision Systems and supersedes all prior agreements or understandings, whether written or oral. If any provision of this agreement is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
